BLUF. Your form has 88 days before it turns sour and gets automatically rejected. In other words, it times out. The ATF can’t complete approvals at their normal pace in < 88 days, much less with millions of gun owners submitting forms for SBRs. When your forms time out, it creates enforcement action for the ATF since you now have an unapproved SBR, for which you have sent your name, pictures, address, SS # and virtually every other piece of identifying information. Read that again. ENFORCEMENT ACTION.

Nothing like helping the Feds get the info they need to throw you in jail for 10 years & fine you $250,000.00. You apply for the free stamp, you give them that info with the application.

Now when they apply that ENFORCEMENT ACTION when your denied after 88 days, everything firearm related goes home with them, guns, ammo & they kill your dog.

Normally, you apply to build a SBR & pay your tax fee. When you get your stamp 10 months later, you now can build your SBR. This action they are putting forth tells them that you have already taken possession of the braced pistol & want your free tax stamp. Now life gets easy as you no longer have to go to work because you are locked up for 10 years.

As a side note. Why apply for an SBR permit so you can keep that goofy, ill fitting pistol brace on your firearm when you can instead apply for a permit to build an SBR with a real stock on it?

This can of worms stinks more by the minute.

If you really want an SBR with all the regulatory shit show that goes with it, ditch that brace on that AR pistol, break it down into "just a box of parts" and apply for an SBR permit like in the olden days. Then build one with a proper stock on it once you have permit in hand. Of course, you will have to pay instead.

Can't someone just take the rear stock off brace or regular stock and call it a pistol? It would just have the piston?

True.... maybe. Wording of the rule is such that even just the recoil spring tube could be considered to have enough surface area to be considered shoulderable. Amazing how the placement, or lack of, a simple punctuation mark can turn a sentence from clear to vague. Writing up vauge shit seems to be an ATF specialty.
