Potential problem: Cops are yelling to take his hand out of his pocket. He takes his hand out of his pocket. Cop shoots.

So far the West Valley PD has said, "All department policies were followed."

And I strongly doubt the DA will indict because there is not much uproar about it.

But if this were placed in front of a jury, I am not convinced they would feel the cop had a reasonable fear of imminent bodily harm, which is necessary to justify the shooting.

However, since this was a home invasion, if the homeowner had shot the kid, the homeowner would not be charged.

Had his left hand up but kept right hand in pocket. Looked like he was pulling something from his right pocket. All he had to do was show BOTH of his hands when ordered to do so. Bet he had a gun in his right hand.
