Default Appeal Promised After District Court Sides with ATF in Unfinished Receiver Case

I post this here, because it relates to building firearms. I believe, if this ruling is allowed to stand, it will be devastating to the build hobby - not just for 80% receivers.

The United States District Court for the Southern District of California ruled against Ares Armor in its lawsuit against the Bureau of Alcohol, Tobacco, Firearms and Explosives in a decision filed Thursday. United States District Judge Janis L. Sammartino, a George W. Bush appointee, ordered dismissal of plaintiff claims.

if they were approved by the BATF as 80 % so be it. if these attributes were added after the fact it pretty much shoots the 80% argument to hell.

Why any gun companies are in California (or Illinois for that matter) is beyond me. Get the hell out and let their economies implode! Also avoid legal hassles like that one.

There is no such animal as an 80% receiver. It is either a receiver. Or it is not. There is NO mention of 80% receivers in the ATF rules and regulations but a LOT of information on what defines a firearms receiver. You fuck with that 80% shit at your own peril. I have sold many hundreds of AKM receivers that are completely bent, the rails welded in along with the makers marks and serial numbers roll engraved onto them. NO holes drilled in the sides. No machine work done to the mag wells or top rails.

Guess what...they are considered RIFLE RECEIVERS and so logged into and out of my logbooks.

Of course I have not been selling them for a LOT of money. BUT...guys who have more time than money have sucked them up because the hardest parts are already done.

Now...it is time to begin selling off the ones that have MORE machine work done to them....or that are ONLY missing a center rivet. A bit more $ but still a bargain.
